New law mandates data exchange of crypto assets

The Netherlands Enterprise Agency (RVO) has announced that the Law on the implementation of the EU directive on data exchange for crypto assets is in preparation. With this new cryptocurrency legislation, the government aims to create more transparency in the crypto market. The measure focuses on making digital currencies such as Bitcoin, Ethereum, and other crypto assets more visible to the Tax Authority.

 

Addressing tax evasion through crypto

For the tax authorities, cryptocurrencies have long been a blind spot. Although Dutch taxpayers are required to declare their crypto holdings in Box 3, effective control has been difficult due to the lack of data from crypto exchanges and trading platforms. With the introduction of this law, based on the European DAC8 directive (EU 2023/2226), this will change.

Cryptocurrency providers are required to collect and report user data and transaction information. This provides the tax authorities with better insight into cryptocurrency assets and actively combats tax evasion with crypto.

Pas na publicatie in het Staatsblad of de Staatscourant treedt de informatieplicht officieel in werking. Tot die tijd hoeven ondernemers en cryptobezitters hun werkwijze nog niet aan te passen.
