The Dutch cryptocurrency sector has been shaken once again by a significant development. The Public Prosecution Service (OM) has requested the court to declare the cryptocurrency platform Kraken bankrupt. According to the judiciary, intervention is necessary because there are serious doubts regarding the company's financial settlement and the protection of customer funds.

Concerns about the handling of credits

Kraken ceased its services earlier this month after it became clear that the company did not have the required license to continue operating under the new European regulations. Since then, the trading platform has no longer been available to users.

What makes the situation even more worrying is that customers are no longer receiving payments. This has made it uncertain when and how users will regain access to their funds.

According to the Public Prosecution Service, a bankruptcy procedure is currently the most suitable route to create order in the situation that has arisen. If the court grants the request, a trustee will be appointed to investigate which assets are available and how these can be distributed as fairly as possible among creditors and customers.

New European crypto regulations put pressure on the sector

The problems at Kraken are closely related to the implementation of the European MiCA regulation (Markets in Crypto-Assets). This legislation introduces stricter requirements for providers of crypto services within the European Union.

Companies that want to offer or trade crypto assets must now have a license from the Authority for the Financial Markets (AFM). Without this permission, trading platforms are not allowed to continue their activities.

For Kraken, this meant the end of operational activities after it became clear that the platform would not receive a license.

FIOD investigates possible criminal offenses

In addition to the civil procedure, a criminal investigation has now also been initiated. The FIOD is conducting an investigation into possible violations of financial legislation.

As part of that investigation, several locations have recently been searched. Digital data has been secured and assets of the company have been seized. To the best of our knowledge, no individuals have been arrested at this time.

The investigation must determine whether there have been any criminal offenses or irregularities within the company's operations.

What does this mean for customers?

For users of Knaken, the situation remains uncertain for the time being. When the court decides to declare bankruptcy, a trustee will be responsible for further proceedings.

It will investigate, among other things:

  • which possessions are still available;
  • what obligations exist towards customers;
  • in what manner any benefits may be provided.

For many customers, this probably means that they will have to wait for a while until more clarity emerges about the company's financial position.

Trust in the crypto sector under pressure again

The events surrounding Kraken illustrate how important oversight and regulation have become in the rapidly growing cryptocurrency market. Where the sector could operate relatively freely for years, the new European rules are resulting in a clear shift towards stricter control and greater consumer protection.

For investors, this situation serves as a reminder of the importance of careful risk management and choosing providers that fully comply with applicable laws and regulations.

In the coming weeks, it will become clear whether the court will grant the bankruptcy petition and what consequences this will ultimately have for the thousands of customers who still have funds with the platform.
